BY USING THE SINGLECARE SERVICE, ACCESSING OUR APP OR OTHERWISE GIVING US YOUR INFORMATION, YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY. 1. Information we collect

1.1 INFORMATION YOU PROVIDE

(a) Personally Identifiable Information. To use the SingleCare Service, and thus become a 'Member', you will be required to provide us with certain Personally Identifiable Information as described below. We may collect some or all of this information through various forms and in various places through the SingleCare Service and our Site, including account registration forms, contact us forms, or when you otherwise interact with us. If you become a Member, you will be required to create a user profile account with us ('Account'). The current required data fields include, but are not necessarily limited to:

  • Email address
  • Password
  • Home phone number
  • Mobile phone number
  • Credit card number, expiration date & security code and or information regarding your PayPal, Google Wallet or other digital payment accounts.
  • Photo of yourself, which will be used for security purposes. If you do provide a photo, it will be viewable by us and Providers of the SingleCare Service at the time you seek Healthcare Services from such Provider. You may remove or update the photo at any time by logging into your Account.

1.2 INFORMATION WE COLLECT AS YOU ACCESS AND USE OUR SITE AND SINGLECARE SERVICE

(a) Generally. In addition to any Personally Identifiable Information or other information that you choose to submit to us, we and our third-party service providers may use a variety of technologies that automatically (or passively) collect certain information whenever you visit the Site or access or use the SingleCare Service or App ('Non-Personally Identifiable Information').Non-Personally Identifiable Information may include the browser that you are using, the URL that referred you to our Site, and how and when you use the SingleCare Service. We may use Non-Personally Identifiable Information for various reasons, such as providing and enhancing the SingleCare Service for you and other users. In addition, we may collect your IP address or other unique identifier that identifies the device from which you access the Site, SingleCare Service or App. This identifier is a number that is automatically assigned to your device and which our computers use to identify you and your device This information may be non-identifying or may be associated with you. If we associate any Non-Personally Identifiable Information or information that identifies your device with your Personally Identifiable Information, we will treat it as Personally Identifiable Information.

(b) Geo-Location Information. We may collect information as you navigate our Site or use the SingleCare Service through the use of a mobile App, which may include geographic location.

(c) Cookies. A cookie is a data file placed on a computer or other device when it is used to access our Site or SingleCare Service. A Flash cookie is a data file placed on a device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your device. Cookies and Flash cookies may be used for many purposes, including, without limitation, remembering you and your preferences and tracking your visits to our web pages. Cookies work by assigning a number to the user that has no meaning outside of the assigning website.

If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. Cookies can be disabled or controlled by setting a preference within your web browser or on your device. (d) Web Beacons. Small graphic images or other web programming code called web beacons (also known as '1x1 GIFs' or 'clear GIFs') may be included in our web and mobile pages and messages. The web beacons are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored in a user's computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. Web beacons or similar technologies help us better manage content on our SingleCare Service by informing us what content is effective, count users of the SingleCare Service, monitor how users navigate the SingleCare Service, count how many emails we sent that were actually opened or to count how many particular articles or links were actually viewed.

(e) Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Site and SingleCare Service, such as the links you click on.The code is temporarily downloaded onto your device from our web server or a third party SingleCare Service provider, is active only while you are connected to the SingleCare Services, and is deactivated or deleted thereafter.

 

1.3 INFORMATION THIRD PARTIES PROVIDE ABOUT YOU

We may, from time to time, supplement the information we collect about you through our Site or App with outside records from third parties in order to provide the SingleCare Service to you, enhance our ability to serve you, to tailor our content to you and to offer you opportunities to purchase products or SingleCare Services that we believe may be of interest to you. For example, we may collect information from third party Providers that you visit when using the SingleCare Service.

Rakuten Advertising may collect personal information when you interact with our digital property, including IP addresses, digital identifiers, information about your web browsing and app usage and how you interact with our properties and ads for a variety of purposes, such as personalization of offers or advertisements, analytics about how you engage with websites or ads and other commercial purposes. 1.4 INFORMATION COLLECTED BY OUR MOBILE APP

you may use the SingleCare Service by accessing our App on a mobile device. By doing so, we may collect and use technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals,

  • Your preferred language and country site (if applicable).
  • Your phone number or other unique device identifier assigned to your mobile device - such as the Mobile Equipment ID number.
  • The IP address of your mobile device.
  • The manufacturer and model of your mobile device.
  • Your mobile operating system.
  • The type of mobile Internet browsers you are using.
  • Your geolocation.
  • Information about how you interact with the Mobile Application and any of our web sites to which the App links, such as how many times you use a specific part of the mobile application over a given time period, the amount of time you spend using the App, how often you use the App, actions you take in the App and how you engage with the App.
  • Information to allow us to personalize the SingleCare Services and content available through the App.

We may use information automatically collected by the App in the following ways:

  • To operate and improve our App and SingleCare Service.
  • To create aggregated and anonymized information to determine which App features are most popular and useful to users, and for other statistical analyses.
  • To prevent, discover and investigate violations of this Privacy Policy or any applicable terms of SingleCare Service or terms of use for the App, and to investigate fraud.
  • To customize the content or SingleCare Services on the App for you, or the communications sent to you through the App.

 

1.5 USER INFORMATION.

Unless otherwise noted elsewhere in this Policy, Personally Identifiable Information and Non-Personally Identifiable Information shall be collectively referred to as  "User Information".

 

2. How We Use The Information Described in This Policy

2.1 TO PROVIDE THE SINGLECARE SERVICE.

We use the Personally Identifiable Information you provide us when registering for an Account to provide the SingleCare Service to you. We will also use such information to communicate with you in response to your inquiries, To Provide the SingleCare Service you request, and to manage your account. We will communicate with you by email, telephone, or SMS or text message (with your consent), in accordance with your requests.

 

2.2 SINGLECARE SERVICE USAGE.

We use User information to monitor when users visit and use Providers for Healthcare Services so that we can process payments for services and otherwise provide benefits to SingleCare Members.

 

2.3 IP ADDRESS.

We use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our Site. Your IP address is used to help identify you, but contains no Personally Identifiable Information about you.

 

2.4 MESSAGES.

We will send you strictly SingleCare Service-related announcements when it is necessary to do so. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

 

2.5 MISCELLANEOUS.

In addition, we may use User Information: (1) to provide users with requested information or SingleCare Services or process transactions, or provide special offers or promotional materials on behalf of us or third parties;2) to process user registration with the SingleCare Service, including verifying information is active and valid; (3) to improve the SingleCare Service, to customize user experience with the SingleCare Service, or to serve specific content that is most relevant to a user; (4) to contact users with regard to use of the SingleCare Service and, in our discretion, to make changes to the SingleCare Service or our policies; (5) for internal business purposes;(6) for inclusion in our data analytics; and (7) for purposes disclosed at the time users provide us with their information, or as otherwise set forth in this Privacy Policy.

 

3. How and When We Disclose User Information to Third Parties

3.1 GENERALLY

We do not sell, share, rent or trade the information we have collected about you, including Personally Identifiable Information, other than as disclosed within this Privacy Policy or at the time you provide your information We do not use your Personally Identifiable Information for direct marketing purposes or share your Personally Identifiable Information with third parties for those third parties' direct marketing purposes unless you consent to such use or sharing. We may share Non-Personally Identifiable Information, such as aggregated user statistics and log data, with third parties for industry analysis, demographic profiling, to deliver targeted advertising about other products or SingleCare Services, or for other business purposes.

 

3.2 WHEN YOU AGREE TO RECEIVE INFORMATION FROM THIRD PARTIES.

You may be presented with an opportunity provide your Personally Identifiable Information in order to receive information and/or marketing offers directly from parties unrelated to us. If you do agree to have your Personally Identifiable Information shared, your Personally Identifiable Information will be disclosed to such third parties and all information you disclose will be subject to those third parties' privacy policies. 3.3 THIRD PARTIES PROVIDING SINGLECARE SERVICES ON OUR BEHALF.

We use third party companies and individuals to facilitate our SingleCare Services, provide or perform certain aspects of the SingleCare Services on our behalf, and other third-parties to host the SingleCare Services, design and/or operate the SingleCare Services' features,track the SingleCare Services' analytics, process payments, engage in anti-fraud and security measures, provide customer support, provide geo-location information to our drivers, enable us to send you special offers, perform technical SingleCare Services (e.g., without limitation, maintenance SingleCare Services, database management, web analytics and improvement of the SingleCare Services' features), or perform other administrative SingleCare Services. We may provide these vendors with access to User Information, including Personally Identifiable Information. This information sharing is limited to only the information needed by the vendor to carry out the SingleCare Services they are performing for you or for us. Each of these vendors are obligated not to disclose or use Personally Identifiable Information for any other purpose and when required by law, SingleCare will enter into special contracts with the vendors strictly limiting the vendors' ability to use and disclose Personally Identifiable Information and requiring the use of certain security measures by the vendors.

 

3.4 CO-BRANDED SINGLECARE SERVICES

Certain aspects of the SingleCare Service may be provided to you in association with third parties that will be disclosed and identifiable to you, and we may disclose Personally Identifiable Information to such parties in accordance with applicable law.

 

3.5 ADMINISTRATIVE AND LEGAL REASONS..

If we receive requests for information from government and law enforcement officials and private parties in regards to enforcing and complying with the law and in connection with private lawsuits, we will disclose User Information to these parties as we reasonably determine is necessary to comply with applicable law. For example, we may disclose User Information: (i) to satisfy any applicable law, regulation, subpoenas, governmental requests or legal process; (ii) to protect and/or defend our Terms and other policies; (iii) to protect the safety, rights, property or security of the Company, our SingleCare Service or any third party; (iv) to protect the safety of the public for any reason; (v) to detect, prevent or otherwise address fraud, security or technical issues; and/or (vi) to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity.

 

3.6 BUSINESS TRANSFER

We may, to the extent permitted by law, share all User Information with our parent, subsidiaries and affiliates for internal, business related (non-marketing) purposes. We also reserve the right to disclose and transfer all User Information: (i) to a subsequent owner, co-owner or operator of the SingleCare Service or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.

 

4. Online Behavioral Advertising and Options

4.1 GENERALLY

Behavioral Advertising uses information collected about an individual's web or mobile browsing behavior such as the pages they have visited or the searches they have made. This information is then used to determine which advertisements should be displayed to a particular individual.

 

4.2 OPT-OUT

To opt out of this data collection process, click here to access the NAI Opt-Out Page. Please note that this will opt you out of targeted ads from us and any other participating advertisers. If you opt out, you may continue to receive online advertising from us; however, these ads may not be as relevant to you.

 

4.3 OPTING OUT OF COOKIES

In order for behavioral advertising opt-outs to work on your device, your browser must be set to accept cookies. If you delete cookies, buy a new device, access our SingleCare Services from a different device, log in under a different screen name, or change web browsers, you will need to opt-out again. If your browser has scripting disabled, you do not need to opt out, as online behavioral advertising technology does not work when scripting is disabled. Please check your browser's security settings to validate whether scripting is active or disabled.

 

5. Account Changes and Cancellation

5.1 ACCURACY CHANGES

You are responsible for maintaining the accuracy of your Personally Identifiable Information. If your Personally Identifiable Information changes, or if you no longer desire to use the SingleCare Service, you may correct, delete inaccuracies, or amend your Account information by visiting our member information page. Changes will be made as soon as practicable. If you wish to cancel your account or request that we no longer use your information to provide you SingleCare Services, visit our member page or contact us using the information below.

 

5.2 RETENTION OF INFORMATION.

We will retain User Information for as long as an Account remains active. Even after an account is terminated, we may retain certain User Information as necessary to comply with our legal and regulatory obligations, resolve disputes.

 

6. A Note About Children

Our SingleCare Service and App are not directed to nor intended for minors. No one under 18 is allowed to register with or use the SingleCare Service. As such, we do not knowingly collect Personally Identifiable Information from anyone under the age of 18. If we discover that we have collected Personally Identifiable Information from a person under 18, we will delete that information immediately. If you are a parent or guardian of a minor under the age of eighteen (18) and believe he or she has disclosed Personally Identifiable Information to us, please contact us.

 

7. How we Protect Your Information

User Identifiable Information is stored within our databases using standard, industry-wide, commercially reasonable security practices and procedures such as encryption, firewalls and SSL (Secure Socket Layers). We also implement security measures required by law. However, as effective as such technology and efforts may be, no security system is infallible and impervious from attack or hacking. Therefore, we cannot guarantee the security of our databases, nor can we guarantee that User Information won't be intercepted while being transmitted to us over the Internet or wireless communication,, or accessed when stored on our or our service providers' servers and any information you transmit to us, you do at your own risk. To help us protect your information, we strongly encourage you to not share your username or password with anyone.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

 

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We do not provide these deletion rights for B2B personal information.

 

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate yourself as an authorized agent, please attach a verifiable notarized document granting you permission to submit any such request on the minor’s behalf.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

 

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include fields listed above.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicableFor data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you services.
  • Charge you different prices or rates for services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of services.
  • Suggest that you may receive a different price or rate for services or a different level or quality of services.
